Terms and Conditions

It is extremely important that clients carefully review and read our Booking Conditions, Terms and Conditions before making a reservation with Guate Magic Tour. By making a reservation with us, you warrant that you have the authority to accept the terms of these Booking Conditions individually and on behalf of your entire group.


CONTRACT FOR SERVICES

A services contract with Guate Magic Tour is initiated after a reservation confirmation email or document has been issued. This occurs once Guate Magic Tour has received full payment for the contracted tour. By acquiring any of the services offered by Guate Magic Tour, the client accepts and declares knowledge of these Booking Conditions, Terms and Conditions.

PRICING INFORMATION

  • All prices are per person and are set in United States Dollars (USD$).

  • Flight fares to Flores are dynamic and subject to change. They must be confirmed prior to booking.

  • The prices of the services offered only include what is specifically stated in the “Inclusions / Exclusions or Includes” section found in each Tour, Itinerary, and/or Quotation.

  • The price of the services offered does not include Visas, airport taxes, exchange rate fees, and/or entry and exit fees, vaccination certificates, unspecified meals, “extras” such as coffee, wine, liquor, mineral water, special dietary regimes (unless expressly agreed upon), laundry and ironing services, optional hotel services, and generally, any other service not expressly listed in the “Tour or Package Price Includes” section or not specifically detailed in the itinerary.

  • The prices of the services provided are subject to change without prior notice.

AIRLINE SERVICES

  • The client accepts that Guate Magic Tour acts solely as an intermediary and releases the Tour Operator from any liability in case of equipment changes, schedule changes, flight cancellations, among others, by the airlines.

  • The client accepts that Guate Magic Tour, in its capacity as an intermediary, is not in a position to issue refunds or service replacements in case of contract breach by the airlines.

  • Any additional expenses resulting from a contract breach by the airlines (i.e., flight cancellations, schedule changes, equipment changes, cessation of flight operations, and other similar issues) will be borne solely by the client or must be negotiated directly with the airline.

  • Helicopter Tours: All sales are final and incur a 100% cancellation penalty. The client must negotiate any compensation directly with the airline or company.

TRANSPORTATION SERVICES

  • Guate Magic Tour reserves the right to contract the type of vehicle it deems most appropriate for each of the services offered, considering the destination and the number of passengers.

  • Climatic reasons, inconveniences arising from natural events, equipment defects, and/or any other fortuitous or unforeseen cause outside the control of Guate Magic Tour may cause delays and/or suspension of visits, which will not imply any type of obligation or liability on the part of Guate Magic Tour under any circumstances.

HOTEL SERVICES

  • Guate Magic Tour, in its capacity as a Tour Operator, reserves the right to contract national and international hotels according to the category chosen by the clients.

  • The planned hotels are subject to availability. Should the planned hotel not have availability, one of the same category and similar quality will be provided, with prior notification to the client of the change.

  • If, for any reason, at the moment of Check-in, the client is dissatisfied with the hotel chosen, Guate Magic Tour is not responsible for changes or refunds.

  • The usual Check-in time is 3:00 PM (15:00 hours) and Check-out is 11:00 AM (11:00 hours).

  • In case of cancellation by the client, Guate Magic Tour and the client must adhere to the cancellation conditions of the accommodation providers.

NO-SHOW CONSIDERATIONS

  • Any cancellation must be notified via e-mail and must be confirmed by Guate Magic Tour. No refund will be issued if the client fails to show up.

  • For trips scheduled between December 20th and January 5th, Easter Week (Semana Santa), and Guatemalan Public Holidays, cancellations must be made 30 days in advance, otherwise, they will be penalized with 100% of the cost.

  • No-Show: A No-Show will be considered when the passenger does not show up for any reason or arrives late for their departure. This situation does not generate a refund for the trip or any of the contracted services.

  • Airline tickets and helicopter tours are subject to the policies of the aerial companies. We disclaim responsibility for refunds upon issuing or contracting any of these services.

LIABILITY AND OBLIGATIONS

  • Services not provided due to a force majeure issue attributable to Guate Magic Tour or our collaborators will be reimbursed or compensated with a service of equal cost to the omitted service.

  • The agency or passenger accepts that Guate Magic Tour is not responsible for the alteration or omission of the services offered in situations beyond our control: natural disasters, adverse weather conditions, or any other unpredictable natural phenomenon; as well as social problems, strikes, demonstrations, or accidents in general. In such cases, the omitted service is non-refundable.

  • To provide better service and safety to passengers, Guate Magic Tour reserves the right to alter the program to overcome any difficulty that may arise.

  • Guate Magic Tour will not be liable for any injury or damage to any passenger or be subject to a lawsuit for acts of passive or active negligence. The agency or passenger expressly releases and discharges Guate Magic Tour from any type of claim.

  • Guate Magic Tour reserves the right to refuse, accept, or retain any person from a tour. If any participant withdraws from a tour, there will be no refund to the participant.

  • Guate Magic Tour reserves the right to cancel a tour in cases of force majeure or if we determine that a client does not meet the necessary physical or mental conditions to participate in the experience, even if the reservation was initially accepted.
